Under the Equality Act 2010 there are nine protected characteristics making it unlawful to discriminate on the grounds of sex, race, age, religion or belief, disability, gender reassignment, marriage or civil partnership and maternity and pregnancy. Discrimination in regard to equality and diversity can come in the forms of direct, indirect, associate, perceptive, harassment and victimisation. In addition when we consider it is often the ‘perception’ of the person who feels they are being, for example harassed and the complexities of managing ‘banter’ within the workplace it is an area that companies must take seriously.

This course is designed for managers and employees and will give an understanding of what their legal responsibilities are within the workplace for eliminating discrimination. This course can be tailored to suit the needs of the company and as such the duration can vary. Options range from half a day to a full day and also 2 – 3 hours for bite size refresher training. We would recommend annual or bi annual equal opportunities training for managers and staff. 

Claims against you

Anyone can make a claim against a company on the grounds of discrimination, they don’t even have to be an employee and this can often include applicants during the recruitment stage. In 2012/13 there were over 23,000 claims in Employment Tribunals on the grounds of discrimination and these are likely to increase now that employees need to have two years’ service to claim unfair dismissal – there is no service requirement for a discrimination claim.

Failure to comply

Failure to comply with these employment laws can be costly as there is no cap on discrimination awards made to either employees or potential employees. Just as importantly the negative publicity such cases attract can have a devastating impact on an organisation and its workforce.
