New Guidance Published on Disciplinary and Grievance Procedures
New guidance on the forthcoming statutory disciplinary and grievance procedures is now available from Workplace Law.
The 50-page commentary Statutory Disciplinary and Grievance Procedures in the Workplace: Analysis and Commentary on the New Law
has been compiled by leading employment-law barrister Daniel Barnett, and comes complete with template disciplinary and grievance procedures.
The New Procedures
The long-awaited Employment Act 2002 (Dispute Resolution) Regulations 2004
come into force on 1 October 2004. The main requirements are as follows:
- Employers must follow a new standard dismissal and disciplinary procedure where they wish to dismiss an employee or take disciplinary action on grounds of conduct or capability.
- Employers must also implement a standard grievance procedure for employees to follow when they raise a complaint.
Importantly, if the employer has not followed the procedures in a dismissal case, this will be found to be an automatically unfair dismissal.
Employers Need to Act Now
Employers are advised to review their disciplinary and grievance procedures to make sure that they comply with the new statutory procedures. Managers, supervisors, and anyone in a position to take disciplinary action should certainly be alerted to these new procedures.
