Garden leave

Garden Leave can be used by employers when an employee has tendered their resignation at work and the employer wants to remove them from the work place.


An employer may choose to do this to protect company information or sales data when an employee is leaving to work for a competitor.


When Garden Leave is implemented an employer will require the employee not to attend their normal place of work for some of the total duration of the notice period, they may also relieve the employee of some of all of their normal contractual duties during this time.


All contractual entitlements and benefits, including remuneration will continue as normal throughout the Garden Leave period and implementing Garden Leave should not be used as a punitive response to receiving a resignation.
Employers can only implement Garden Leave where they have a contractual right to do so.
